Introduction

Come and See Foundation, Inc. ("Come and See," "we," or "us") is a nonprofit organization incorporated in North Carolina, with its principal offices in Colorado Springs, Colorado. We help make The Chosen series available to audiences worldwide. We own The Chosen brand and work with 5&2 Studios, Inc. ("5&2"), the original producer of The Chosen, to create, distribute, and support The Chosen and related content.

This Privacy Policy explains how we collect, use, and share Personal Information or Personal Data when you use:

Together, these are called "The Chosen Digital Platforms" or the "Services."

When we say "you," we mean anyone who uses the Services, including guests who use the Services without an account, users who create and use an account, and donors who give to support our work.

What We Mean by "Personal Information"

"Personal Information" (sometimes called "Personal Data") means any information that identifies you, describes you, or could reasonably be linked to you, your device, or your household, either on its own or when combined with other information.

That includes obvious things like your name, email address, phone number, mailing address, and payment details. It also includes less obvious things like your account ID, device identifier, IP address, approximate location, the content you watch, and information we infer about your interests from how you use our Services.

It does not include information that has been fully anonymized or aggregated so that it can no longer be linked back to you.

By using The Chosen Digital Platforms, you confirm that you have read this Privacy Policy and understand how we collect, use, and share your information. If you do not agree with our information practices, please do not use the Services.

Because we are based in the United States, your Personal Information may be stored and processed in the U.S. and in other countries where we or our service providers operate, which may have different privacy laws than where you live.

This Policy is drafted in English. Any translation is provided for convenience only. In the event of any conflict between the English version and any translated version, the English version shall govern.

Summary of Information We Collect

We collect two main types of Personal Information: (1) information you give us directly, such as your name, email address, or payment details when you create an account or make a donation; and (2) information collected automatically when you use the Services, such as device details and content viewing activity.

We use this information to provide and improve our services, process donations, recommend content, keep our systems secure, and meet our legal obligations.

Information We Collect

The types of Personal Information we collect depend on how you use our Services and what you choose to share with us. We may collect the following categories of Personal Information:

  • Personal Identifiers - such as your name, postal address, email address, date of birth, cellphone number, device ID, and other online identifiers.
  • Demographic Information - such as your gender, age, or zip code.
  • Content Information - such as video and content viewing information, social media posts, email messages, and other communications.
  • Internet Activity Information - such as browser type, browser version, webpages visited, content viewed, and IP address. If you are using the App, we may also collect location, device ID, and other unique device identifiers.
  • Geolocation Information - which we can sometimes determine indirectly from your IP address.
  • Audio, Visual, or Electronic Information - such as photos or videos you upload or share through the Services.
  • Inferences - drawn from your use of the Services, including your preferences and interests.
  • Sensitive Information - With your permission and only when relevant to your use of the Services, we may process limited sensitive information, including information that reveals your religious or philosophical beliefs, and your precise geolocation (collected only if you enable location permissions on your device). Where this processing is subject to the GDPR or UK GDPR, we rely on your explicit consent and, where applicable, as a not-for-profit body with a religious aim.
  • Donor Information - When you make a donation, we collect payment details (such as credit card or bank account information), the amount and designation of your gift, and your name, mailing address, phone number, and email address. We use this information to process your donation, provide receipts and annual giving statements, maintain business and tax records, and communicate with you about your gift and related stewardship matters. We treat donor information as especially sensitive. We do not share donor giving history, donor financial information, or donor payment information with third parties for independent marketing or promotional purposes.

We also receive personal information from third-party sources, including 5&2, in connection with joint operation of the Services; from social logins (Google, Apple, Facebook) if you use them; and from business partners and service providers. We do not treat as private any information you choose to make public.

How We Use Your Information

Purposes and Legal Bases

We collect and use your personal information only when we have a lawful reason to do so under U.S. and applicable international data protection laws. The table below describes how we use your information and the legal basis for each use.

"Needed to provide the Service you asked for" means we need the information to give you what you signed up for. Under GDPR, this is called a "contract" basis.

"Required by law" means a statute, regulation, or court order tells us we have to process the information. Under GDPR, this is called a "legal obligation" basis.

"Your consent" means we process the information only because you said yes. You can change your mind at any time.

"Our legitimate interest" means we use the information for a reasonable business purpose that does not override your rights. You can object, and we will stop unless we have a compelling reason to continue.

Automated Collection (Cookies and Similar Tools)

When you use the Services, we automatically collect information using cookies, pixels, and similar tools to recognize you and your devices, remember your settings, help keep your account secure, and improve site and app performance. The information we collect may include pages or content you view, searches, date and time of activity, URLs of referring and exit pages, IP address, proxy server, operating system, browser and add-ons, device identifier and features, and ISP or mobile carrier. We do not share your personally identifiable information, device identification, or precise location with third parties for their own advertising without your explicit permission. Manage your cookie preferences by visiting any page on our sites and selecting “Cookies Settings” in the footer, or through browser or device settings. If you block cookies, some parts of the Services may not work fully.

Artificial Intelligence Tools

Come and See may use third-party AI tools to support limited internal business functions and, in some cases, to improve your experience with our Services, subject to applicable law and our internal governance policies. We minimize personal information sent to AI tools, apply human review where appropriate, and use contractual and technical controls to protect your information. We do not use personal information submitted to these tools to train, refine, develop, or improve any AI model, whether ours or a third party's. Disclosing and Sharing Your Information

Come and See does not sell your personal information to third-party advertisers or ad networks for their own advertising purposes. We share your information only as described below. Depending on how "sale" and "sharing" are defined by the privacy law applicable to you, consent-based disclosures to 5&2 for joint Chosen-branded marketing purposes may constitute a "sale" or "sharing" of personal information (for example, under the CPRA); you may exercise opt-out and consent-withdrawal rights as described in Section (c) below and in our U.S. States Privacy Notice.

(a) Service Providers

We may share personal information with vendors and service providers who help us operate the Services, including providers of cloud hosting and storage, analytics and auditing, marketing and communication tools, payment processing and fraud detection, and recruiting or operational support. Service providers are contractually obligated to use your information only to perform services for us and may not use it for their own purposes or share it with others.

(b) Analytics Vendors

We may share information with trusted analytics partners to understand how the Services are used, under agreements designed to protect your privacy.

(c) 5&2 Studios (Business Partner and Joint Controller)

We work closely with 5&2 to produce and share The Chosen content and to support related Chosen-branded goods and services. Come and See owns The Chosen brand, and 5&2 produces Chosen-branded content for Come and See. For certain co-branded digital activities, Come and See and 5&2 act as joint controllers under applicable data protection laws pursuant to a data sharing agreement. Come and See is your primary point of contact for privacy questions or requests related to these shared activities, and we will coordinate with 5&2 to respond to verified requests.

To operate and improve the Services, prevent fraud and abuse, understand how people use the Services, and support co-branded communications, we may share information with 5&2 such as account details, device and browser information, cookie and similar data, approximate location, and information about how you interact with content. Absent your consent, any sharing with 5&2 is limited to the purposes described in this Policy and, where applicable, to aggregated, anonymized, or de-identified information.

Sharing with 5&2 - Consent Required. With your consent, Come and See shares personal information with 5&2 for the following two purposes:

  • Joint Chosen-branded marketing - marketing of The Chosen brand (which Come and See owns) and Chosen-branded content, goods, and services produced by 5&2; and
  • 5&2 non-Chosen-branded biblical content promotion - enabling 5&2 to promote non-Chosen-branded content produced by 5&2 that is similar in biblical nature and of interest to viewers of The Chosen.

If you have not provided consent, we do not share your personal information with 5&2 for either of these purposes. Come and See does not share your personal information with 5&2 for any marketing or advertising purpose outside these two purposes.

You may withdraw your consent for either or both purposes at any time by contacting us using the information in the “Contact Us” section. Once you withdraw consent, we will stop sharing your personal information with 5&2 for the corresponding purpose on a going-forward basis and will coordinate with 5&2 as needed to honor your choice, as the law requires.

Donor Information. Donor information is never sold or shared with any third party for that third party's own purposes. Donor information is shared only with vendors, service providers, and affiliates, under Come and See's direction and pursuant to contractual agreements, solely to process and analyze donor information in support of Come and See's operations.

(d) Affiliates

We may share information with affiliated entities that support Come and See's mission and operations, subject to this Privacy Policy.

(e) Merger or Acquisition

We reserve the right to share personal information confidentially in connection with a potential or actual merger, acquisition, or sale of all or part of our assets. We will provide notice as required by applicable law.

(f) Law Enforcement and Legal Process

We may disclose information when required by law, subpoena, court order, or other legal process, or when we believe in good faith disclosure is reasonably necessary to investigate or prevent illegal activity, assist law enforcement, enforce our agreements, defend against third-party claims, protect the security or integrity of the Services, or protect the rights and safety of Come and See, our users, personnel, or others. We attempt to notify users about legal demands for their personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency, and we may dispute demands we believe are overbroad, vague, or lack proper authority.

(g) At Your Direction

We may share information with third parties when you instruct us to do so or otherwise clearly authorize such sharing, such as when you connect your account to a third-party service. Their use of your information is governed by their own privacy policies.

Information You Share Publicly

We do not treat as private any information you choose to share publicly. User contributions are posted and transmitted at your own risk, and we do not accept liability associated with user contributions. This Privacy Policy applies only to sites and apps owned and operated by Come and See; you are responsible for reviewing the privacy statements of any third-party sites or apps linked from our Services.

How Long Will We Keep Your Data?

We retain your personal data no longer than necessary for the purposes for which it was collected or until you withdraw consent or object, except where we have a legal right or obligation to retain it for regulatory, tax, accounting, fraud-prevention, audit, security, or dispute-resolution purposes. Financial and donation records are retained for the periods required by applicable tax and accounting law.

Your Privacy Choices and Rights

Depending on your location, you may have the following rights regarding your personal information:

  • Right to know. You have the right to request that we disclose the categories of personal information we collected about you, the categories of sources from which we collected the personal information, the categories of personal information that we sold or disclosed, our business or commercial purpose for collecting and selling your personal information, the categories of third parties with whom we shared your personal information, and the specific pieces of personal information we collected about you.
  • Right to correct. You have the right to request in certain circumstances that we correct any inaccurate personal information that we have collected directly from you. To protect your personal information, we are required to verify your identity before we can act on your request. You may also update your information by contacting us at legal@comeandseefoundation.org.
  • Right to delete. You have the right to request that we delete the personal information we have collected about you, subject to certain exemptions.
  • Right of data portability. You have the right to request a portable copy of your personal information, to the extent technically feasible, in a readily accessible format.
  • Right to withdraw consent. You have the right at any time to withdraw consent previously given. Note that the withdrawal of consent does not affect the lawful processing of your personal information that occurred prior to such withdrawal.
  • Right to opt-out of, limit, or restrict certain uses of your personal information (e.g., targeted advertising, sale, sharing or profiling).
  • Non-Discrimination. You have the right not to be discriminated against for exercising the rights above.
  • The right to lodge a complaint with your local data protection authority. If you are in the European Economic Area (EEA), Switzerland, or the United Kingdom (UK), you may lodge a complaint (but before doing so, please tell us your concerns so that we can try to solve them). CAS will take steps to verify your identity before processing your request. We may not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected personal information. We will only use the personal information provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the personal information for another purpose. If we cannot verify your identity to comply with a request, we will explain the reason in our communication to you.

Authorized Agents

You may designate an authorized agent to submit requests on your behalf, subject to written authorization and identity verification as permitted by applicable law.

Appeals

If we deny your request in whole or in part, we will explain our decision. In some locations you may appeal by contacting legal@comeandseefoundation.org with "Privacy Appeal" in the subject line.

Choices About Sharing with 5&2

In some cases, you can choose whether we may share certain personal information with 5&2 for updates about The Chosen, related services, events, or merchandise. Where these choices are available, we will explain them clearly and provide a way to update your preferences, for example, through a "Privacy Choices" or "Do Not Sell or Share" page on our sites. You can update your preferences at any time by contacting us using the information above.

Deleting Your Account

You can delete your Come and See account in The Chosen App by tapping the menu icon (≡), selecting Personal Info, then selecting Delete Account. On the web, visit watch.thechosen.tv, click the menu icon (≡) in the top right, select Personal Info, then select Delete Account. We aim to complete account deletion within approximately 45 days after verification; backups or caches may take up to an additional 30 days. Information already shared with others or appearing in third-party services may remain visible until those services update their records.

Security

We use encryption in transit and at rest and a range of additional safeguards. No system is perfectly secure, and using the internet carries inherent risk, which you acknowledge and assume by using the Services. We cannot warrant or guarantee that information provided through the Services will be free from unauthorized intrusion or that data will not be accessed, disclosed, altered, or destroyed by breach of any physical, technical, or managerial safeguard.

Notice of Security Incidents

We may provide notice of a security incident by email to your account email; by posting to a publicly facing page of our sites or through in-app messages; or by major statewide media or telephonic means, including calls or text messages, even if sent via automated means including automated dialers. Standard text and data messaging rates may apply. Notices by email are effective when sent; notices by posting are effective upon posting; notices by in-app messaging are effective when made; notices by telephonic means are effective when transmitted or dialed. You consent to receive electronic communications from Come and See related to your use of the Services. If an incident involves data we process jointly with 5&2 or another partner, we will coordinate to meet applicable legal notice and response requirements.

You cannot opt out of important service messages related to security or your use of the Services.

International Users

Come and See is incorporated in North Carolina with offices in Colorado Springs, Colorado. By submitting your information, you agree to transfer, storage, and processing of your information in the U.S. and other countries where we or our service providers operate. For transfers from the EEA, UK, or Switzerland, we rely on Standard Contractual Clauses and, for UK transfers, the UK International Data Transfer Addendum. EEA, UK, and other eligible users have the rights identified in "Your Privacy Choices and Rights" and may lodge a complaint with your supervisory authority. U.S. State Privacy Rights

Some U.S. state laws give residents additional privacy rights beyond those described in this Policy. Depending on where you live, these may include the right to:

  • Confirm whether we are processing your personal information
  • Request access to certain personal information we hold about you
  • Ask us to delete the personal information we have collected about you, subject to legal exceptions
  • Ask us to correct inaccurate personal information
  • Receive certain personal information in a portable, usable format
  • Withdraw your consent previously given
  • Opt out of targeted advertising, certain "sales" or "sharing" of personal information, or certain profiling that has legal or similarly significant effects
  • Not be discriminated against for exercising the above rights

Children

Our Services are intended for people 18 and older. We do not knowingly collect personal information from anyone under 18, and we do not allow people under 18 to create a user account. If you believe we may have collected information from a child under 18, contact legal@comeandseefoundation.org.

Changes to This Policy

We may update this Privacy Policy. Material changes will be accompanied by additional notice as required by law. Your continued use after the "Last Modified" date constitutes acceptance of the updated Policy except where additional consent is required by law.
