International Privacy Policy

About This Policy

This International Privacy Policy goes with the Come and See Foundation, Inc. ("Come and See," "we," "us," or "our") Privacy Policy. It applies to you if you live outside the United States in a country where Come and See operates or offers the Services, including countries in the European Economic Area ("EEA"), the United Kingdom ("UK"), Switzerland, and other jurisdictions with data protection laws that give you rights in your Personal Data. Come and See currently operates in multiple international jurisdictions; the specific jurisdictions may change from time to time.

If anything in this International Policy conflicts with the Privacy Policy on a matter governed by the data protection law that applies to you, this International Policy controls.

This Policy is drafted in English. Any translation is provided for convenience only. In the event of any conflict, inconsistency, or ambiguity between the English version and any translated version, the English version shall govern and control.

Who Is Responsible for Your Personal Data

Come and See Foundation, Inc. is responsible for your Personal Data (in legal terms, we are the "controller" or equivalent). You can reach us at 9540 Federal Drive, Suite 250, Colorado Springs, CO 80921 or legal@comeandseefoundation.org. Where the law requires, we will appoint a local representative and identify them here.

What We Collect and Why

The types of Personal Data we collect, why we use them, and who we share them with are described in our Privacy Policy (see "Information We Collect," "How We Use Your Information," and "Disclosing and Sharing Your Information"). This International Policy builds on those descriptions; it does not repeat them.

"Personal Information" (sometimes called "Personal Data") means any information that identifies you, describes you, or could reasonably be linked to you, your device, or your household, either on its own or when combined with other information.

That includes obvious things like your name, email address, phone number, mailing address, and payment details. It also includes less obvious things like your account ID, device identifier, IP address, approximate location, the content you watch, and information we infer about your interests from how you use our Services.

It does not include information that has been fully anonymized or aggregated so that it can no longer be linked back to you.

Our Legal Reasons for Using Your Personal Data

We only use your Personal Data when we have a legal reason to do so. In plain terms, those reasons are:

  • To give you what you asked for - for example, running your account, delivering content, and processing your donation.
  • Because the law requires it - for example, keeping tax records or responding to a court order.
  • Because you said yes - for example, sending you marketing emails, setting non-essential cookies, sharing certain information with 5&2 for the two purposes described below, and processing sensitive information.
  • Because we have a reasonable business reason that does not override your rights - for example, improving the Services, preventing fraud, keeping the Services secure, and protecting our rights and those of others.

When we rely on your consent, you can change your mind at any time. Withdrawing consent does not affect anything we lawfully did with your Personal Data before you withdrew it. When we rely on a reasonable business reason, you can object at any time, and we will stop unless we have a compelling reason to continue.

Purposes and Legal Bases

The table below describes how we use your information and the legal basis for each use.

"Needed to provide the Service you asked for" means we need the information to give you what you signed up for. Under GDPR, this is called a "contract" basis.

"Required by law" means a statute, regulation, or court order tells us we have to process the information. Under GDPR, this is called a "legal obligation" basis.

"Your consent" means we process the information only because you said yes. You can change your mind at any time.

"Our legitimate interest" means we use the information for a reasonable business purpose that does not override your rights. You can object, and we will stop unless we have a compelling reason to continue.

Sharing with 5&2 Studios

Come and See owns The Chosen brand. 5&2 Studios, Inc. ("5&2") is the original producer of The Chosen and produces Chosen-branded content for Come and See. For certain co-branded digital activities, Come and See and 5&2 act as joint controllers (or the local-law equivalent) under a data sharing agreement. If you are reading a privacy policy from Come and See, then Come and See is the Service Operator under the data sharing agreement and your primary point of contact for privacy questions or requests about these joint activities, and we will coordinate with 5&2 to respond to verified requests.

With your consent, we share Personal Data with 5&2 for two purposes:

  • Joint Chosen-branded marketing — telling you about The Chosen brand and Chosen-branded content, goods, and services produced by 5&2; and
  • 5&2 non-Chosen-branded biblical content promotion — enabling 5&2 to tell you about other, non-Chosen-branded content it produces that is similar in biblical nature and may be of interest to viewers of The Chosen.

If you have not given consent, we do not share your Personal Data with 5&2 for either purpose. Come and See does not share your Personal Data with 5&2 for any marketing or advertising purpose outside these two purposes. You can grant or withdraw consent for either or both purposes at any time by changing your preferences or by contacting legal@comeandseefoundation.org.

Donor data is never sold or shared with any third party for that third party's own purposes. Donor data is shared only with vendors, service providers, and affiliates acting on our behalf, under our direction and under contract to support Come and See's operations.

Your Privacy Rights

Subject to the limits of the law in your country, you may have some or all of the following rights:

  • Access - get a copy of the Personal Data we hold about you.
  • Correction - ask us to correct inaccurate or incomplete Personal Data.
  • Deletion - ask us to delete your Personal Data.
  • Restriction - ask us to limit how we use your Personal Data in certain situations.
  • Portability - receive certain Personal Data in a portable, usable format.
  • Objection - object to uses based on our reasonable business reasons, and object to direct marketing at any time.
  • No solely automated decisions with legal or similarly significant effects - in most cases, you can ask that a person be involved.
  • Withdraw consent - where we rely on your consent, withdraw it at any time.
  • Complaint - lodge a complaint with your local data protection authority. Before you do, we hope you will contact us so we can try to resolve your concern.

To use any of these rights, email legal@comeandseefoundation.org. We will respond within the time required by the law that applies to you, often about one month, with additional time for complex requests. We may ask you to verify your identity before we act on your request.

International Data Transfers

Come and See is based in the United States, so your Personal Data may be transferred to, stored in, and processed in the United States and in other countries where we or our service providers operate, including countries that your local law may not consider to offer an equivalent level of protection. When we transfer Personal Data from your country to another country, we use the safeguards required by the law that applies to you. For transfers from the EEA, UK, or Switzerland, we use the European Commission's Standard Contractual Clauses and, for UK transfers, the UK International Data Transfer Addendum or Agreement, together with additional measures where needed. We apply the specific module of the Standard Contractual Clauses that fits the particular transfer, for example, controller-to-controller, controller-to-processor, or between joint controllers. For transfers from other jurisdictions, we use the safeguards and mechanisms that the local law recognizes, such as approved standard contracts, binding internal rules, certifications, or your consent, depending on the country. You can ask us for a copy of the safeguards that apply to transfers of your Personal Data.

How Long We Keep Your Personal Data

We keep your Personal Data only as long as we need it for the purposes described in the Privacy Policy, or until you withdraw consent or object, unless we have a legal right or obligation to keep it longer, for example, for tax, accounting, audit, fraud prevention, security, or dispute-resolution reasons. Donation and financial records are kept for the periods required by law.

Security and Data Breaches

We use encryption in transit and at rest, and other reasonable safeguards, to protect your Personal Data. No system is perfectly secure, and we cannot guarantee that Personal Data will never be accessed without authorization. If a Personal Data breach is likely to create a risk to your rights, we will notify the relevant regulator within the time required by the law that applies to you, and we will notify you directly if the breach is likely to create a high risk to you.

Cookies and Similar Tools

Our use of cookies and similar tools is described in the Privacy Policy and, where applicable, in a separate Cookie Policy. Where required by the law that applies to you, we ask for your consent before placing non-essential cookies on your device.

Artificial Intelligence Tools

Come and See may use third-party AI tools to support limited internal business functions and, in some cases, to improve your experience with our Services, subject to applicable law and our internal governance policies. We minimize personal information sent to AI tools, apply human review where appropriate, and use contractual and technical controls to protect your information. We do not use personal information submitted to these tools to train, refine, develop, or improve any AI model, whether ours or a third party's. For information about our AI providers, contact legal@comeandseefoundation.org.

Children

Our Services are intended for people 18 and older. We do not knowingly collect Personal Data from anyone under 18. If you believe we may have collected Personal Data from a child under 18, please contact legal@comeandseefoundation.org. Where local law sets a different age of consent for information society services, we will apply the higher standard. We do not allow anyone under 18 to create an account but do allow people under 18 to view content as a guest. Personal Data will not be collected from guests.

Country-Specific Information

Come and See operates in multiple international jurisdictions. Where local law gives you additional or different rights, or imposes additional requirements on us, those local rules will apply to you in addition to this International Policy. If you would like information about how a specific country's law applies to your Personal Data, contact legal@comeandseefoundation.org.

Changes to This Policy

We may update this International Policy from time to time. We will post the updated policy and revise the "Last Modified" date. If the changes are significant, we will give you additional notice as required by the law that applies to you.
